Please read these terms carefully before using FDwears.

EU Customers — Right of Withdrawal (Widerrufsrecht)

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party you nominate (other than the carrier), take physical possession of the goods.

To exercise this right, notify us before the 14-day period expires by a clear statement (e.g. letter or email) sent to:

Effects of withdrawal: If you withdraw, we will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days after we receive notification of your withdrawal, using the same payment method you used. We may withhold reimbursement until we have received the goods back or until you provide evidence of having sent them back, whichever is earliest.

You must return the goods to FDwears, Stockumer Str. 218, 44225 Dortmund, Germany without undue delay and no later than 14 days after notifying us. You bear the direct cost of returning the goods.

The right of withdrawal does not apply to goods made to your specifications or clearly personalised (e.g. bespoke custom orders).

The leniency described above (no reason required, minimal conditions) applies to withdrawals notified within this 14-day statutory period. Our standard 30-day Return & Refund Policy — including its return-authorisation, original-condition, and packaging requirements — applies in full to any return requested after the 14-day statutory withdrawal period has ended.

These Terms & Conditions (“Terms”) govern your use of fdwears.com and any purchase made through the website. By accessing or using this website you agree to be bound by these Terms. If you do not agree, please discontinue use of the website.

These Terms are governed by the laws of the Federal Republic of Germany. Where mandatory consumer protection laws of your country of residence provide greater rights, those rights are not affected.

1. Online Store Terms

You confirm that you are at least 18 years of age (the age of legal majority in Germany), or that you have obtained verifiable parental or guardian consent to use this website and make purchases.

Our products and services must not be used for unlawful purposes or in violation of any applicable local, national, or international laws. Breach of these Terms may result in immediate suspension or termination of your account and access to our services.

2. General Conditions

We reserve the right to refuse service or cancel orders at any time for reasons including but not limited to: suspected fraud, abusive behaviour, technical pricing errors, or stock unavailability. We will not refuse service on the basis of race, gender, religion, disability, age, sexual orientation, or any other characteristic protected under the German General Equal Treatment Act (AGG) or applicable EU law.

Credit card and payment data is always encrypted during transfer via SSL. Other information you submit may be transmitted across networks in the ordinary course of internet communications.

3. Accuracy of Information

We strive to ensure all product descriptions, prices, and images are accurate. We reserve the right to correct errors or omissions at any time without prior notice. Minor differences in product appearance may occur due to photographic lighting and display settings.

4. Pricing & VAT

For visitors in the European Union, prices displayed on the website are shown inclusive of applicable VAT (Mehrwertsteuer / MwSt), calculated automatically based on your location. For all other visitors, prices are shown exclusive of VAT; where applicable, taxes and any shipping fees are calculated and clearly shown at checkout before you confirm your order. Prices are listed in USD. If you are paying in another currency, your bank or payment provider applies the prevailing exchange rate. Product prices may be updated from time to time; the price applicable to your order is the price shown at the time you place it.

5. Contract Formation

Placing an order constitutes an offer by you to purchase the selected products. The contract is formed as follows:

Step 1 — You place your order and complete payment at checkout.
Step 2 — Order acknowledgement — you receive an automated email confirming we have received your order. This is not yet an acceptance of your offer.
Step 3 — Order confirmation — our support team contacts you to confirm your size and specifications. The binding contract is formed at this point, once we confirm your order in writing by email.
Step 4 — Dispatch — once confirmed and dispatched, you receive a shipment notification with your tracking number.

We reserve the right to decline any order after acknowledgement, in which case we will notify you promptly and issue a full refund.

6. Products & Services

Some items may only be available online and in limited quantities. All products are subject to our Refund & Return Policy. Bespoke and custom-size orders may have different production lead times and may not be eligible for standard returns unless the item is faulty or incorrectly supplied.

7. Delivery & Shipping

Orders are processed within 5–7 business days of confirmed payment, excluding weekends and public holidays. Orders placed after 2:00 PM CET are processed on the next business day. Bespoke and custom-size orders follow a separate production timeline — see our Bespoke page for details.

Every item is inspected by our Quality Control team before dispatch. All international orders are shipped Delivery Duty Unpaid (DDU) — customers are responsible for any customs duties or import fees upon delivery. EU orders have VAT applied at checkout. We do not ship to PO, FPO, or APO box addresses. A signature is required upon receipt. Delivery timeframes are estimates and may be affected by courier performance, customs processing, or circumstances beyond our control.

8. Payment Methods

Full payment is required at checkout. Orders are only confirmed once payment clears. Payment details are never stored on our servers — all transactions are processed through encrypted, PCI-DSS-compliant payment gateways. For high-value purchases, additional identity verification may be required.

9. Billing & Account Accuracy

You agree to provide accurate, current, and complete account and payment information. We may refuse or cancel any order we reasonably suspect involves fraud, a pricing error, or a violation of these Terms. Unauthorised chargebacks will be contested. For any billing concerns, please contact us at support@fdwears.com before initiating a chargeback.

10. Retention of Title

All goods supplied by FDwears remain our property until payment has been received in full. Risk of accidental loss or damage passes to you upon delivery of the goods to the address you specified.

11. Optional Third-Party Tools

We may provide access to third-party tools on an “as is” and “as available” basis, without warranties of any kind. Use of such tools is at your own risk. We are not responsible for the content, accuracy, or availability of any third-party tools or websites linked from our site.

12. Disclaimer & Limitation of Liability

We do not guarantee uninterrupted or error-free access to our website or services. To the maximum extent permitted by applicable law, FDwears shall not be liable for:

Loss or damage to goods in transit before delivery remains our responsibility, not yours — as stated above, risk only passes to you once the goods are delivered. Contact us and we will resolve it directly, including filing any claim with the carrier ourselves, at no cost to you.
Loss, damage, or delay caused by circumstances beyond our reasonable control, including natural disasters, extreme weather, strikes, pandemics, customs delays, or acts of government.
Indirect, incidental, consequential, or special damages arising from use of this website or our products, where those damages were not caused by our own fault.

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other matter where liability cannot be excluded or limited by law.

13. Indemnification

You agree to indemnify and hold harmless FDwears, its directors, employees, and affiliates against any claims, damages, or costs (including reasonable legal fees) arising directly from your breach of these Terms or your misuse of this website.

14. User Submissions

By submitting feedback, reviews, or comments that do not contain personal data, you grant us a non-exclusive, royalty-free licence to use and share that content in connection with our business. You agree not to submit unlawful, harmful, defamatory, or infringing material. Any personal data submitted is handled in accordance with our Privacy Policy and processed only where we have a lawful basis under Article 6 GDPR.

15. Personal Information

Any personal data you provide is handled in accordance with our Privacy Policy, which forms part of these Terms.

16. Prohibited Uses

You may not use this website or its content to: break any law or infringe on the rights of others; spread malware or harmful code; or engage in fraudulent, abusive, or deceptive activities.

17. Severability

If any provision of these Terms is found invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All remaining provisions continue in full force and effect.

18. Termination

These Terms remain in effect until terminated. We may suspend or revoke your access immediately if you breach these Terms. You may terminate your use of the website at any time by ceasing to access it.

19. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. For disputes with business customers, the exclusive place of jurisdiction is Dortmund, Germany. For disputes with consumers, applicable jurisdiction is determined by the mandatory consumer protection laws of your country of residence. EU consumers retain the benefit of any mandatory provisions of the law of their country of residence.

20. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

21. Updates to These Terms

We may revise these Terms at any time by posting the updated version on this page with a new “Last updated” date. Continued use of the website after any change constitutes your acceptance of the revised Terms.

22. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Refund & Return Policy, and Billing Terms & Conditions, constitute the entire agreement between you and FDwears.

23. Language

These Terms are provided in English. A German-language version (AGB auf Deutsch) is available upon request — please contact us at support@fdwears.com.
